Who we are

VesselOne is operated and maintained by MCY Limited, a company registered in New Zealand. In these terms, "we" and "us" mean MCY Limited, and "you" means the person or company using VesselOne.

The agreement

By using this site or the VesselOne product you accept these terms. If you accept them on behalf of a company, you confirm you have authority to bind that company.

Your account

You are responsible for keeping your account credentials secure and for everything done under your account, including by the users you invite. Tell us promptly if you believe an account has been compromised.

Acceptable use

Do not use VesselOne for anything unlawful, do not attempt to breach its security or to access another company's data, and do not resell or provide access to third parties without a written agreement with us.

Your data

You own the data you enter. You grant us the licence we need to host it, back it up, and display it to you and the users you authorise. We do not use your data to train machine learning models, and we do not sell it.

Availability

During early access the product is provided as-is, with no guaranteed uptime. We will give notice of planned maintenance where we reasonably can, and we will tell you about any material change that affects how you use the product.

Fees

Early access is free. If we introduce paid plans, we will tell you the price before charging anything, and billing starts only once you accept it.

Liability

To the extent the law allows, our total liability to you is limited to the fees you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot lawfully be limited, and where you acquire VesselOne as a consumer, the Consumer Guarantees Act 1993 applies and is not excluded.

Termination

Either of us may end this agreement by giving notice. After termination you can export your data for 30 days, after which we may delete it.

Governing law

These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction over any dispute.
